Sellers - Terms and conditions

This is a contract between you and picturenation Limited, based on you being the copyright holder of the photograph(s) you submit for sale. If you assign your copyright in the photograph(s) to a third party you must notify picturenation in writing immediately. You shall indemnify us against all and any loss, damages or costs sustained by us arising out of any failure by you to notify us immediately or arising out of any claim by a third party relating to the photograph(s) sold by you to picturenation and sold by picturenation to third parties pursuant to this contract prior to such assignment of copyright. You must be familiar with copyright rules.

You must agree to picturenation's terms and conditions before uploading any images for sale.

Submitting your images to the picturenation website does not guarantee sales of your image(s). The publication of your images to the picturenation website does not guarantee sales of your image(s).

By submitting the photograph to picturenation, being the sole author of the photograph, waive absolutely your moral rights arising under Chapter 4 of the Copyright, Designs and Patents Act 1988 and, so far as is legally possible, any broadly equivalent rights you may have in any territory of the world. (this refers to picturenation using your member name to publicise your photo)

picturenation Limited has the undisputed right to reject any photographs you submit if they do not meet the company's required criteria, if they are not of suitable quality or size, or if there is a question about copyright.

picturenation Limited is not liable for any actions taken as a result of misinformation provided by the seller of the photograph, or for any disagreement about a photograph provided by the seller. As the seller, you must only upload photographs you know you have permission to sell.

Photographs submitted to picturenation Limited should not be the result of an illegal or tortious act, i.e. trespass or harassment. For more details you must familiarise yourself with our copyright rules.

picturenation Limited is not liable for any action taken against the photographer/copyright holder for photographs submitted to picturenation.

You cannot purport to be an employee of picturenation Limited, or acting on the company's behalf in the pursuit of or sale of photographs.

You can have both a Seller's and a Buyer's account on picturenation.

ABOUT COPYRIGHT:

By licensing your photographs to picturenation you retain the copyright of your photos and are free to sell them elsewhere.

If you sell the copyright of any of your photos that are featured on picturenation you must tell us immediately.

You must read our section about Copyright before you submit content to picturenation.

YOUR COMMISSION:

picturenation Limited agrees to pay you 40% of the sale price on each photograph sold and downloaded from the picturenation website

picturenation Limited is a royalty-free image provider. In submitting your photographs for sale through picturenation, you agree that buyers pay just once for that photograph and can use that image as many times as they like (*with the exception of mass commercial reproduction). If you request the removal of any images that have been sold royalty-free through picturenation, the sale remains valid and cannot be refunded or retracted.

*For commercial mass reproduction, you are entitled to royalty payments of 40% on each single print reproduction over 300,000. Each print over 300,000 incurs a royalty payment of GBP £0.01p, in addition to the initial commission payment.

By submitting your images to picturenation you agree that all the images you submit, however high the resolution, can be licensed as website resolution images as well. Your commission is based on the pre-VAT price of each image sold.

HOW WE PAY YOU:

When you register you will have access to an online form for you to fill in your personal details as well as options for payment.

picturenation pay commission by request, when accounts reach GBP £50. You can request payment via your My picturenation account when you are eligible for payment. Payment dates are every 8 weeks. If you request an eligible payment, you will be paid by your chosen method on the next available payment date. The payment dates are given in your My picturenation account in the My Sales section. Details about commission payments are in the Seller's Info on the website.

28 days need to be allowed for clearance of payment from buyers before commission can be issued. You can track your image sales through your My picturenation account.

FILE SIZES FOR SUBMISSION:

We do not have a minimum file size. This enables us to work with small picture sizes applicable to our web resolution images.

You can currently upload up to 5 images at a time. When added together the total upload file size can be up to 50Mb.

GETTING YOUR PICTURES ON THE SITE:

You must agree to these terms and conditions before you can submit images for licensing through picturenation.

We also offer a Sellers' Guide to help you in submitting images we think will sell. Every image submitted to picturenation has to be checked before it can go live on the site. If your photograph is rejected we will endeavour to give you a reason.

We reserve the right to reject any image at our discretion.

We cannot guarantee how long it will take to check and upload your images, but you will receive notification by e-mail or via your My picturenation account when your images go live.

Once you've registered you will be able to follow simple instructions about how to get your images uploaded to the picturenation website for clearance to go live. We've made it an easy and straightforward process.

CHILD PICTURE POLICY:

Pictures of children are highly sought after for legitimate and safe use - i.e., a child eating an apple to illustrate a story about healthy eating.

The directors of picturenation are parents themselves and take very seriously the issue of child photographs on the internet. We need your good images of children doing everyday things - playing, reading, eating, etc. and want you to be confident that you can submit such images without fear of them being mis-used.

We have devised a policy stipulating that anyone wanting to download an image featuring a child must tell us why they want that picture and where it is to be used, before they will be permitted to download it.

This will help us not only keep track of who is requesting our child pictures but also deter and help prevent anyone from downloading them who does not plan to use them for legitimate purposes. We hope and believe that you will support us in our efforts with this policy.

PN PRO ACCOUNT:

Members can have 5 images live for sale on picturenation free of charge. You agree that for a non-returnable fee of £10 per year you can upload unlimited numbers of images to the site for inspection and sale. Membership fees do not guarantee acceptance of your images. Any discounts or free gifts offered as part of the PN Pro Account membership are not the responsibility of Picture Nation Limited. Membership fees are not refundable in part or full.

REMOVING YOUR IMAGES:

You agree to leave your photograph on the picturenation website for a minimum of 6 months from the date of publication.

If you wish to remove your photograph from the picturenation website after that time you should inform the company by e-mail or in writing and the photograph will be removed within 14 working days from time the request is received. Completed sales transactions to buyers remain valid even if you remove images from picturenation and close your account.

WE DON'T WANT:

picturenation Limited does not accept any photographs featuring nudity, obscenity or cruelty towards people or animals. We don't want images that would be offensive to religious groups, i.e. images depicting the Prophet Mohammed.

WE DO WANT:

You can read our section on images we do need and know are in demand to help you choose which images to submit.

You must read the company's guidelines for sellers before submitting photographs to picturenation.

MARKETING:

You agree that picturenation may use your image if required for marketing purposes expressly for the marketing of picturenation.

It will be necessary from time to time to update and revise these Terms and Conditions and it is advisable for you to occasionally re-check this page so you can familiarise yourself with any new information relevant to you.

It is advisable to re-read these T&Cs from time to time to keep up to date with any amendments and to refresh your memory about the company's policies.
